1. About GoFlight

GoFlight provides software and a directory that lets people looking for a charter flight send trip requests to independent FAA-certificated Part 135 operators. GoFlight is not a party to any charter contract. The operator quotes the trip, contracts with the customer, collects payment and keeps operational control of the flight. GoFlight does not set prices, cancellation terms or refund terms.

GoFlight is not a direct air carrier and does not operate aircraft or exercise operational control. Charter flights offered through GoFlight are operated by FAA-certificated Part 135 air carriers, which keep operational control of each flight. GoFlight is not a party to charter contracts and does not sell or collect payment for air transportation.

2. Acceptance of Terms

By accessing and using GoFlight ("the Platform"), you accept and agree to be bound by these terms. If you do not agree, please do not use this service. These terms apply to all users, including customers, operators, and administrators.

3. Payment

• GoFlight does not sell air transportation and does not process, collect or hold payment for charter flights.
• You pay the operator directly, under the operator's own charter contract. The operator sets the price, collects payment and charges any taxes that apply, including federal excise tax.
• GoFlight's only fee is the company subscription, billed to member companies through Stripe. GoFlight charges no booking fee and takes no commission or other share of the charter price.

4. Cancellation and Refunds

• Cancellation and refund terms are set by each operator in its charter contract.
• Cancellations, refunds and disputes about a flight are between you and the operator, under the operator's contract. GoFlight does not issue refunds for charter flights and does not decide charter disputes.

5. User Responsibilities

All Users

• Provide accurate, current, and complete information during registration and use.
• Maintain the security of your password and account.
• Accept responsibility for all activities under your account.
• Comply with our Acceptable Use Policy.

Passengers

• Provide accurate trip details and passenger information.
• Review bids in good faith and respond in a timely manner.
• Contract with and pay the operator you choose directly, under that operator's charter contract.

Charter Operators

• Maintain valid certifications, insurance, and regulatory compliance at all times.
• Provide accurate pricing, aircraft, and capability information.
• Honor accepted bids and deliver services as quoted.
• Promptly update certifications and fleet information when changes occur.

6. Limitation of Liability

GoFlight is provided on an "as is" and "as available" basis. To the maximum extent permitted by law:

• GoFlight is not responsible for the actual provision of charter flight services.
• GoFlight makes no warranties regarding safety, quality, or legality of operator services.
• GoFlight is not liable for flight delays, cancellations, or other service issues.
• GoFlight's total liability shall not exceed the platform fees paid by you in the preceding 12 months.
• GoFlight is not liable for any indirect, incidental, or consequential damages.

7. Disputes

A dispute about a charter flight, including its price, payment, cancellation or refund, is between the customer and the operator and is resolved under the operator's charter contract. GoFlight is not a party to that contract, does not mediate charter disputes and holds no charter funds.

8. Account Termination

GoFlight reserves the right to suspend or terminate user accounts for violation of these terms, fraudulent activity, failure to maintain required certifications, or repeated complaints.

9. Privacy

Your use of GoFlight is also governed by our Privacy Policy, which is incorporated into these terms by reference.

10. Governing Law

These terms are governed by the laws of the State of Delaware and the United States, without regard to conflict of law principles.
